Citation John Gawn, Ireland, to Thomas Gawn, Ireland.

This Indenture made the twenty second day of July in year of our Lord one thousand eight hundred and forty eight. Between John Gawn of Donegore in the country of Antrim found of the one part, and Thomas Gawn of Halftown in the country of Antrim aforesaid names of the other part.------ Whereas by Indenture of lease leaving date the fifteenth day of April one thousand eight hundred and one, Hugh Cairns of Parkmount in the county of Antrim aforesaid Esquire for the considerations therein mentioned did demise grant and to farm let unto James Gawn farm as parcel of land in Ballyclaverty then in his possession containing by estimation seventy six acres or thereabouts by the same more or less. To Hold unto the James Gawn his executors, administrators and assigns from the first day of November then last for the term fifty one years subject to the yearly rent of forty two pounds thirteen Shillings and three half pence of the currency, and to performance of the several covenants and agreements therein contained.

And Whereas by indenture of conveyance leaving date the first day of August one thousand eight hundred and eight said James Gawn for the considerations therein granted and sold unto Robert Gawn of Ballyclaverty farmer, the one merely moiety or half of that portion of said lands then in the possession of said Robert Gawn and of, Andrew Gawn containing forty acres Irish measure or thereabouts be the same more or less (exceeding as in said lease is excepted) To hold the said last mentioned moiety unto the said Robert Gawn his executors administrators and assigns for the remainder of said term granted by said recited lease, subject to the yearly rent of eleven pounds eighteen shillings and ten pence half penny of said currency as the proportionable part of said reserved rent.

And Whereas the said Robert Gawn------ sometime afterwards died but before his death he made and published his last will and testament in writing leasing date the twenty fifth day of December one thousand eight hundred and nineteen, whereby he left and bequeathed his entire interest in said last mentioned moiety of said farm to his son William Gawn who afterwards having attained his age of twenty one years thereupon became possessed of said last mentioned moiety of said farm and legally entitled to the original estate and interest of the said James Gawn therein.

And Whereas..... the said William Gawn afterwards sold an assigned part of his said moiety containing about five acres and one rood, and also by deed of assigned bearing date the twenty second day of March one thousand eight hundred and forty two parted and sold to the said John Gawn party hereto the residence of his said moiety contain about fourteen acres and those roods and the said John Gawn has now agreed to sell his unto interest in said last mentioned lands to the said Thomas Gawn for the sum of forty nine pounds sterling.

Now this Indenture Witnesseth that in pursurance said agreement and in consideration of the said sum of forty nine pounds sterling to the said John Gawn well and truly paid by the said Thomas Gawn at and before the ensealing and deliver of those presents, the receipt whose of he doth hereby acknowledge, and thereof and there from and of from every part thereof he doth acquit, exonerate, release and discharge the said Thomas Gawn his executors, administrators and assigns for ever by these presents, he the said John Gawn halt granted, bargained, sold assigned, transferred and made ever, and by those presents doth grant, bargain, sell, assign, transfer and make ever unto the said Thomas Gawn to his executors, administators and assigns, All that and those that piece or parcel containing by estimation fourteen acres and three roods Irish measure or thereabouts be the more or less being the part of the lands granted by the said recited deed of conveyance which the said John Gawn is new possessed of and entitled to bounded on the North by Murdoch's land, on the East by lands held by Andrew Gawn and by John Gawn the South by lands in possession of Malcom Barklie and on the West by lands in of said Andrew Gawn together with all the houses, buildings, ways, waters, watercourses right members and appurtenances thereunto belonging, and the reversions, remainders, rents, issues and profits thereof, and of every part thereof and all the estate right title and interest, property, profit, claim and demand whatsoever of him the said John Gawn his exceed and administrators or of any person in trust for him or them, and all deeds, leases, writings and evidences of little in his, their or any of their hands custody, power as procurement in any wise relating to said lands or any part thereof (excepting as in the said part recited lease is excepted) all which said lands and tenements are situate lying and be in the parish of Donegore upper half barony of. Antrim and county of. Antrim aforesaid, To have and To hold - all and singulars the said hereby as intended to be hereby grant lands and tenements with the appurtenances unto the said Thomas Gawn his executors ministrators and assigns as fully as aforesaid from the first day of November next and for and during the full rest, residue and remainder of the said term of fifty one years commencing and to be computed from the said first day of, November which was in the year one thousand eight hundred subject to the yearly rent of eight pounds five shillings and pence being the proportionable part of the said reserved rent payable out of the said hereby your lands and tenements, and to performance of a like proportion of the covenants and agreements said lease contained.

And the said John Gawn doth hereby for himself execute administrators, and assigns, covenant, promise and agree to and with the said Thomas Gawn his executors, administrators and assigns, in manner and from following that is to say that he the said John Gawn now hath in himself good right, full power, and law and absolute authority to make and execute this present grant and assignment of the said portion of said lands and tenements aforesaid and every grant thereof in manner from as he has hereby taken upon himself to do free and clear, and freely and clearly recited, exonerated and discharged of from and against all manners of former and other grants, bargains, sales, devises, mortgages, judgements, executions and all incumbances, what nature or Kind serves, at any time heretofore committed, emitted or suffered him the said John Gawn or by any person or persons whomsoever. And there he the said John Gawn his executors and administrators, shall and will from time to time and at all times - hereafter well and sufficiently warrant and save harmless and indemnity the said lands and tenements, and the title thereto, said Thomas Gawn his executors, administrators and assigns, and his and their lands, goods and chattels from all such claims, charges and incumrances. And that the said John Gawn his executors and administrators shall and will from time to time and at all time hereafter claiming the term aforesaid at his and their proper costs and changes, make, do and execute a cause and procure to be done and executed all and every such further and other lawful and reasonable acts and assurances in the law whatsoever for the further and more perfectly granting, assuring and confirming the said lands and tenements and every part thereof with the appurtenances unto the said Thomas Gawn his executors administrators and assigns as by him the said Thomas Gawn his executors, administrators and assigns, or any of them or his or their counsel shall be required. And that the said Thomas Gawn his executors, administrators and assigns paying the due proportion of the rent, and performing on his part the covenants and agreements in said lease reserved and mentioned shall and may from time to time and at all times hereafter during the continuance of said demise, peaceably and quietly enter into, have, held, occupy, possess and enjoy the said hereby or intended to be hereby granted and conveyed lands and tenement and every part therof with the appurtenances, without the hindrance, denial, molestation, interruption, disturbance, or eviction of the said John Gawn his executors, or administrators or any of them, or of any person or persons lawfully claiming or deriving or to claim or derive by from or under him, them or any of them.
